Miranda Rights
The Miranda warning is part of a preventive criminal procedure rule that law enforcement are required to administer to protect an individual who is in custody and subject to direct questioning or its functional equivalent from a violation of their Fifth Amendment right against compelled self-incrimination. Miranda rights should be read to a suspect at the earlier point before questioning them. Ensure the suspect is conscious! Miranda rights are not required for a conviction that is evidence based but should still be read in all situation to avoid ambiguity.
The Rights: You have the right to remain silent. Anything you say will and can be used against you in a court of law. You have the right to an attorney, and if you cannot afford one, they will be provided for you, if available.
